Introduction to the role

We develop, build, own and operate grid-scale battery storage projects in key markets around the world.

As Commercial and Contract Manager- Japan, you will be working closely with the Senior Engineering Manager, Senior Investment Manager, Managing Director Japan and reporting to the Procurement and Commercial Director to deliver the execution strategy during the development and construction phase as well leading commercial supply chain liaison activities.

You will be responsible for the overall contracting strategy policies and processes for the entire Japan project pipeline, ensuring contractual suites are fit for purpose, consistent and achieve the best possible risk position for Eku Energy.

You will lead on the engagement and negotiation with external suppliers and project partners and will review all contracts to ensure maximum commercial value for the project. You will be working in a project team to scope packages of work, run procurement tenders and seek new partnerships (frameworks etc) across the project lifecycle for the Japan pipeline of project.

You will have full responsibility for developing and negotiating new contracts with new suppliers as well as supporting the Construction Manager with review of existing project contracts through the execution phase.

Responsibilities of the role

You will be responsible for the management of key supply, construction and maintenance contract procurement activities in Japan to ensure the business delivers on the company goals with strong results and an appropriate risk profile. In order to do this role you must have a strong commercial acumen, extensive contract preparation and negotiation skills, a clear understanding of appropriate commercial risk position and the ability to ensure consistency across multiple contracts and regions.

You will:

· Lead supply, construction and maintenance contract procurement related tasks required to progress projects to commercialisation

· Manage supply chain commercial liaison and developing new partnerships with suppliers

· Manage all tender processes for new BESS and balance of plant (BOP) work packages and evaluating responses

· Manage the development of risk positions and pass through arrangements of all offtake contracts to ensure the lowest possible remaining gap risks

· Lead pre-construction negotiations with BESS and BOP suppliers (drafting Heads of Terms, reviewing engineering requirements/warranty terms/ contract terms) and generally driving the projects towards financial commitment by negotiating a suite of comprehensive contracts that deliver long term value for the asset.

· Manage commercial risk positions in all contracts to ensure consistency across the region and reduce construction and pass through risk to the maximum extent possible

· Support the project team in driving the project to financial close including coordination of due diligence advisors, insurance underwriters, commercial inputs to financial model and LD positions.

· Coordinate with other regional leads on global supply chain contracts and procurement, seeking to increase contract value by leveraging global scale

· Coordinate the transition of management of the contractual obligations to the construction and asset management teams

· Support the delivery and operations teams with issues arising throughout their administration of the contracts

Requirements

· You bring extended expertise and professional experience in construction contract development and negotiations on long term infrastructure projects, preferably gained in an international context in the energy sector.

· You possess sound commercial judgement and strong communication and leadership skills

· You have complimentary experience from an operating business within the energy sector, preferably in storage/renewables

· You have an in-depth understanding of the mechanisms of the Japanese power market

· You have an understanding of best practices for project development, BESS and BOP contract management and asset management across multiple technology classes

· You have experience of construction contracts along with a high level of flexibility to cooperate with project partners in a constructive manner.
