The Head of Compliance is a leader of the local Affiliate Management Team and reports through the AbbVie Office of Ethics & Compliance Organization.   He/she is responsible for providing leadership and direct oversight for AbbVie’s compliance program in Japan.


Summary of Job Description:



  • The Head of Compliance is responsible for direct oversight of the Affiliate’s Compliance Program across AbbVie Japan. 

  • The Head of Compliance role will include the continued enhancement of the Local Compliance Program by executing, through collaborative interactions, risk assessments, monitoring for continuous improvement, recommending effective controls and processes, and creating and delivering compliance training.  The role will also include the management of local compliance policies.


Major Responsibilities:



  • Head of Compliance leads the Office of Ethics & Compliance (“OEC”) team in Japan, representing OEC in a responsible and professional manner, as a strategic business partner. This position reports to the OEC Area Director for Japan & Asia Pacific (JAPAC). This position is a member of the Abbvie Japan Management Team, and is based in Tokyo.

  • Serves as a leader within the OEC organization for Japan and helps the Area Director accomplish key activities within the Region by being accountable for the activities assigned to the Region.

  • Works closely with the Japan compliance committee to ensure Japan has an effective compliance program that includes all the Seven Elements of an Effective Compliance Program.

  • Through working with the Japan Management Team and compliance committee, help establish a culture of compliance with the right “tone from the top” (e.g., the VP and GM) and “tone at the middle” (e.g., Directors and Managers) about the importance of operating in a compliant manner with high ethical standards, and clear communication from Affiliate business management that the business owns and is accountable for the Affiliate’s compliance.

  • Strategically partner with the business stakeholders (e.g. GM, Commercial, Finance, Medical, Legal, Regulatory, Public Affairs) to help the business meet its goals and objectives in a compliant manner.  Strategic partnership requires proactive, as opposed to solely reactive, involvement. The Head of Compliance should identify Legal, Medical, Regulatory Affairs, Human Resources or other relevant issues, refer matters to respective departments, analyze alternatives and propose solutions to the business.

  • Work closely with Legal on matters having both Compliance and Legal implications.

  • Exhibits good judgment in matters that may need to be referred to other functions or to OEC management.

  • Develop, lead and guide a professional and engaged team of OEC members in Japan

  • Serve as a member of select Brand Teams for Japan, providing proactive strategic and tactical advice, guidance and training. 

  • In conjunction with the Affiliate GM, run a robust compliance committee with clear roles and responsibilities and help conduct meaningful meetings, with prepared agendas, active participation by all members at strategic and tactical levels, clear action items, responsibility and deadlines, and minutes that capture key decisions and action items.

  • Maintain thorough knowledge of all industry codes, and in cooperation with Legal, of all applicable laws, regulations, and monitor key developments that would impact the business.  Via training and other means, advise the business regarding existing and future provisions. For future provisions, help ensure appropriate planning and preparation where it will impact the business. 

  • Assist Affiliate with development, implementation, management, maintenance, continuous improvement and interpretation of compliance-related policies, procedures, country specific requirements and practices. Regularly assess existing policies and procedures and ensure they are easy to follow and consistent with current business needs and applicable legal, regulatory and code requirements and address appropriately the relevant risks. 

  • Working with the compliance committee, develop, implement, coordinate, and deliver awareness education, policies and procedures training,  and other necessary training programs that focus on the elements of the Affiliate’s Compliance Program and also are tailored to positions and associated responsibilities. Develop and implement cross-functional guidance materials based on detected gaps or specific business needs, and ensure that training records are centrally maintained.

  • Implement and supervise the Affiliate monitoring plan to ensure compliance with policies and procedures and to identify policy and procedure improvements that can create business process efficiencies.  Follow-up on monitoring results, analyze trends, analyze root cause, contribute to remediation plans, and update country/region compliance program accordingly.

  • Perform compliance risk assessment, trend analysis, root cause analysis and best practice recommendations.

  • Implement, modify and execute Affiliate Internal Investigations’ Procedure and coordinate and provide guidance on the execution of internal investigations, communicating with HQ based OEC when appropriate.

  • Implement, modify and execute Affiliate local system for reporting and responding to concerns as well as corrective actions. Oversee the tracking and trending and propose recommendations for corrective action. 

  • Partner with Affiliate and Auditors on compliance audits, while maintain full objectivity and independence from either. Oversee the fulfillment of auditors’ requests, act as liaison between business and auditors during on-site activities, evaluate and help business respond to preliminary findings and recommendations in an objective and constructive manner, guide the business in preparing corrective action to address findings and  recommendations, and through CSC help remediation owners ensure timely response to and completion of audit recommendations.

  • Actively participate in local industry trade association compliance (or related) committees, helping drive appropriate decision-making on key issues.  When applicable, identify external environment changes and trends, communicate changes to compliance committee and OEC Area Director and implement necessary changes to the Affiliate Compliance Program.

  • Contribute to the success of the OEC organization by supporting global initiatives, as part of an All for One AbbVie approach.



Qualifications

Qualifications, Education, Experience and Knowledge:



  • Bachelor degree required. Compliance, Finance, Audit, Business, Legal or equivalent work experience strongly preferred.

  • Minimum of 12 years of professional experience with, or exposure to, business functions such as compliance, audit, finance, legal, regulatory affairs, government affairs.

  • Experience with healthcare industry
